Welcome to pilotandrutter.com (the “Site”), operated by Pilot and Rutter, LLC, doing business as “Pilot & Rutter” (“Pilot & Rutter,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site. Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Who we are

Except for the limited license in Section 2, nothing in these Terms grants you any right, title, or interest in the Site or its content.

5. Submissions through the Site

If you submit information or materials to us through the contact form, by email, or otherwise (a “Submission”), you represent that you have the right to provide it and that it does not infringe the rights of any third party. Please do not send us confidential, proprietary, or sensitive information through the Site. Submissions are not treated as confidential, and submitting a Submission does not create any obligation of confidentiality on our part unless we have agreed otherwise in a signed writing. You grant us permission to use a Submission as reasonably necessary to respond to you and operate our business.

7. Disclaimer of warranties

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PILOT & RUTTER AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify and hold harmless Pilot & Rutter and its members, managers, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your violation of these Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “Effective date” above. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

12. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pilot & Rutter regarding the Site.
